Terms of Service

1. Acceptance of Terms

By downloading, accessing, or using the Acier mobile application or website (collectively, the “Service”), operated by Personal Asset Vault, LLC (doing business as Acier), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Service. We may update these Terms from time to time and will notify you via email or in-app notice. Continued use after notification constitutes acceptance of the updated Terms.

2. Description of Service

Acier is an AI-powered personal asset inventory platform. The Service provides:

• AR-based room scanning and AI-powered item identification and valuation
• Specialized capture modes for high-value items (collectibles, jewelry, wine, firearms, fine art, designer fashion)
• Insurance coverage analysis, Protection Score calculation, and gap identification
• Claim-ready PDF documentation and CSV export
• Multi-property management and household sharing

The Service uses a device-primary architecture where encryption keys are generated and stored on your device. Data is encrypted before transmission to our servers, which operate under a zero-knowledge model. We cannot access your inventory data.

3. Account Registration

You must create an account using a valid email address and password. You must be at least 13 years of age. You are responsible for maintaining the security of your credentials and for all activity under your account. Because encryption keys are derived from your credentials and stored on-device, losing access to your device and credentials may result in permanent loss of your encrypted data.

4. Subscriptions and Payment

Acier offers three tiers: Free, Pro ($4.99/month or $39.99/year), and Pro+ ($9.99/month or $69.99/year). Additional properties may be purchased as add-ons at $0.99/month each.

All payments are processed through the Apple App Store. Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current billing period. Refund requests must be submitted through Apple. Acier does not directly process or store payment information.

5. Your Content and Data

You retain full ownership of all content you create, upload, or generate through the Service, including photos, inventory data, insurance documents, and reports. You grant Acier a limited license to process this content solely for the purpose of providing the Service.

Under our zero-knowledge architecture, your inventory data is encrypted with keys that only you possess. Acier servers store encrypted data but cannot decrypt or access the contents. AI analysis of items occurs through a stateless proxy — your data is sent to the AI provider for processing and is not retained by either Acier or the AI provider after the response is generated.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to the Service or its infrastructure
• Reverse-engineer, decompile, or disassemble the Service
• Use bots, scrapers, or automated tools against the Service
• Upload malicious code or content
• Impersonate any person or entity
• Use the Service to store or process content that violates any applicable law

7. AI-Generated Content and Valuations

Acier uses artificial intelligence to identify items, estimate values, and analyze insurance coverage. These are estimates only and should not be treated as professional appraisals, financial advice, or insurance recommendations.

Acier employs confidence-gated pricing: when AI confidence in an identification is below 70%, estimated values are withheld rather than displayed, to prevent misleading information. We recommend consulting qualified professionals for high-value items, official appraisals, and insurance decisions.

8. Insurance Lead Generation

Acier may offer optional insurance quote requests. This is strictly opt-in. If you choose to request quotes, limited information may be shared with insurance partners. Acier is not an insurance company, broker, or agent, and does not provide insurance advice or underwriting.

9. Intellectual Property

The Service, including its design, code, algorithms, and branding, is the intellectual property of Acier. Your use of the Service does not grant you any ownership rights in the Service itself.

10. Disclaimer of Warranties

The Service is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee the accuracy of AI-generated valuations, identifications, or insurance analysis.

11. Limitation of Liability

To the maximum extent permitted by law, Acier shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data or profits. Our total liability is limited to the amount you paid for the Service in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Acier and its officers, employees, and agents from any claims arising from your use of the Service or violation of these Terms.

13. Termination

You may delete your account at any time through the app. Upon deletion, all encrypted data stored on our servers will be permanently and irreversibly deleted within 30 days. Locally-stored data on your device is under your control. Acier may terminate or suspend your account for violation of these Terms.

14. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
